End User Licence Agreement (EULA)

Introduction

This End User Licence Agreement ("Agreement") governs your use of Project Mammut, including the Project Mammut Editor, development tools, documentation, and associated software provided by the Licensor.

By installing, accessing, or using Project Mammut, you agree to the terms of this Agreement.

If you do not agree with these terms, you may not use Project Mammut.

Definitions

  • Project Mammut — The game development software, tools, documentation, and associated technologies provided by the Licensor.
  • Editor — The Project Mammut development environment and associated creation tools.
  • Runtime — The software components required for games and applications created with Project Mammut to operate.
  • Game — Any game, application, interactive experience, or other work created using Project Mammut.
  • Licensor — The owner of Project Mammut. At the time of publication, the Licensor is Ben Naulls.

The Project Mammut Promise

Project Mammut is built around the principle that developers should own what they create.

As a Project Mammut developer:

  • You own the games and original content you create.
  • You may publish and sell games commercially.
  • You do not owe royalties or revenue share.
  • There are no revenue caps.
  • Educational use is permitted.
  • Open-source projects are permitted.
  • A free edition of the Project Mammut Editor will always be available.

The Project Mammut Editor itself remains proprietary software owned by the Licensor.

Licence Grant

Subject to this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable licence to use Project Mammut.

You may:

  • Create games and applications.
  • Use Project Mammut for personal, educational, commercial, and professional projects.
  • Publish games created with Project Mammut.
  • Sell games created with Project Mammut.
  • Use Project Mammut within a company or organisation.

Commercial Use

Games created using Project Mammut may be sold commercially.

The Licensor does not claim:

  • Ownership of your games.
  • A percentage of your revenue.
  • Royalties from your sales.
  • Rights to your original creative content.

Ownership

Project Mammut, including the Editor, source code, trademarks, branding, and underlying technology, remains the intellectual property of the Licensor.

This Agreement does not transfer ownership of Project Mammut to you.

You retain ownership of:

  • Your game code.
  • Your artwork.
  • Your audio.
  • Your assets.
  • Your designs.
  • Your original creations.

Editor Restrictions

You may not:

  • Modify the Project Mammut Editor.
  • Reverse engineer the Project Mammut Editor.
  • Redistribute the Project Mammut Editor.
  • Sell, sublicense, or lease the Project Mammut Editor.
  • Present Project Mammut as your own software.

Runtime Licence

The Runtime is licensed separately under the Project Mammut Runtime Licence.

The Runtime may be distributed as part of games created using Project Mammut.

The Runtime may not be:

  • Sold separately.
  • Redistributed as a standalone development framework.
  • Used to create a competing engine or product.

Runtime Modifications

Because the Runtime may be distributed in human-readable formats, including HTML, JavaScript, and related files, users may inspect and modify the Runtime included within their own games.

Modified Runtime files may only be distributed as part of a game or application created using Project Mammut.

Modification of the Runtime does not transfer ownership of the Runtime.

Future Licensing

During the Beta period, the Project Mammut Editor is provided free of charge.

After the Beta period, additional licensing options, features, or editions may be introduced.

A free edition of the Project Mammut Editor will always remain available.

Future paid editions may include additional functionality, services, or features.

Changes to Editor licensing will not affect the rights granted to previously released games under the Runtime Licence.

Support

Project Mammut is provided with community support.

The Licensor does not guarantee:

  • Response times.
  • Continued availability of support channels.
  • Bug fixes.
  • Feature additions.

Third-Party Software

Project Mammut includes third-party software components.

These components remain subject to their respective licences.

Third-party licences are available in the Project Mammut Third-Party Notices document.

Warranty Disclaimer

Project Mammut is provided "as is."

To the maximum extent permitted by law, the Licensor makes no warranties or guarantees regarding:

  • Reliability.
  • Performance.
  • Availability.
  • Suitability for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, the Licensor shall not be liable for damages arising from the use or inability to use Project Mammut.

This includes, but is not limited to:

  • Loss of data.
  • Loss of revenue.
  • Business interruption.
  • Project delays.

Termination

This licence remains effective until terminated.

The Licensor may terminate this Agreement if you violate its terms.

Upon termination, you must stop using Project Mammut.

Games already created and distributed under the Runtime Licence remain unaffected.

Governing Law

This Agreement is governed by the laws of Ireland.

Any disputes shall be handled under the jurisdiction of the courts of Ireland.
